Terms and Conditions


Definitions

"you", "your", "consumer(s)" and "volunteer(s)" means all person(s) named at registration (including any changes or additions at a later date).

"we", "us" and "our" means "Affecting Real Change".

"partner(s)" means "Affecting Real Change (Gambia), Affecting Real Change (India) and Mission for the Rural People (India)" for whom we advertise volunteer opportunities.

"placement(s)" refers to the volunteer opportunities we advertise on behalf of "Affecting Real Change (Gambia), Affecting Real Change (India) and Mission for the Rural People"

Introduction

The following Terms and Conditions together with the information on our website will give you a better idea of what to expect from "Affecting Real Change", our partners, and from your placement. They will also highlight which party is responsible for aspects of your volunteering trip, what to do if something goes wrong and above all help to keep you safe.

Please read all of the Terms and Conditions carefully as they set out our respective rights and obligations.
Since our Terms and Conditions are published on our website, by registering with us we are entitled to assume that you have had the opportunity to read and have read these terms and conditions and agree to them

"Affecting Real Change" may change these Terms and Conditions at any time by posting changes online. Please review these Terms and Conditions regularly to ensure you are aware of any changes. Your continued registration and/or use of our services after any change is posted, means you agree to the changers and agree to be legally bound by these Terms and Conditions.

What does "Affecting Real Change" provide

"Affecting Real Change" offer to individuals and organisations the opportunity to volunteer with our partner organisations.
By registering with us and agreeing to fundraise the minimum donation, we undertake to

  • Advise you if the placement is suitable for you.
  • Pass your details on to our partner organization with whom you are placed.
  • Through the Volunteers area on http://www.affectingrealchange.org walk you through the process (inoculations, visa, travel documents and so on).
  • Regularly liaise with and check all the details with the partner organization.
  • Remind you of items you should take with you, in order to get the most out of your volunteering trip.
  • Inform the partner organisation of you flight details, in order that they can prepare for your arrival (for example collection from the airport).
  • Through our partner organisation arrange your collection from the airport if stipulated in your itinerary.
  • Through our partner organisation provide an in-country English speaking contact for the duration of your placement.
  • Through our partner organisation provide a secure room with nearby sanitation facilities in which you can reside for the duration of your placement. (Please note that facilities can vary from a basic room and drop toilet to an en-suite room with shower)
  • Ensure that a clean water source is available and advise of water treatment chemicals as necessary.
  • Through our partner organisation locally prepare and provide three meals a day.

What "Affecting Real Change" will not provide

  • "Affecting Real Change" is not a package holiday operator or provider. All costs with the exception of the minimum donation are payable locally.
  • We will not arrange or provide any international travel arrangements, although at our discretion we will offer advice as to where to make such arrangements.
  • Travel Insurance.
  • Innoculations.
  • Visa.

Change or cancellation.

In compliance with the "Consumer Protection (Distance Selling) Regulations 2000".

  • Our website and these Terms and Conditions give our consumers clear information on the service offered, any/all goods sold or on offer, any/all delivery arrangements and any/all payments that are to be made to "Affecting Real Change".
  • Consumers have a 7 day cooling-off period.
  • The cooling-off period is not applicable if volunteer(s) have arrived at their placement within 7 days of registration.
  • All cancellations must be made in writing within 7 days of registration.
  • Cancellations made by telephone or email are not acceptable.
  • All cancellations made after the 7 days cooling-off period are non-refundable. This includes but not limited cancellations due to sickness, lack of personal funds, voluntary or involuntary change of itinerary, pregnancy, death of a family member.
  • If "Affecting Real Change" receives a notice of cancellation, and that notice complies with these Terms and Conditions then 100% of the registration fee will be refunded.
  • All refunds with the exception of donations will be paid using the same payment system the consumer used to originally pay "Affecting Real Change" registration fee (for example: if the consumer pays a fee using PayPal, then any refund due will be paid via PayPal).
  • "Affecting Real Change's" registration fee does not cover volunteering trips, it is for our help, allowing you to organise your own volunteering holiday.
  • "Affecting Real Change" cannot stress enough; you are planning to volunteer in a developing world country. You must be aware of, appreciate, and acknowledge that this type of travel requires considerable flexibility. You should plan for and allow for alternatives.
  • You accept that working hours, accommodation, services and placements offered may be subject to alteration or cancellation (sometimes without prior notice).
  • There are many reasons why working hours, accommodation, services and placements are cancelled or changed, this includes but not limited to strikes, projects no longer considered suitable, political disputes, closure of local projects/charities, local management changes, climate and other unpredictable or unforeseen circumstances.
  • We have limited control over our partner organisations. We therefore cannot accept any responsibility if your placement is cancelled or significantly changed.
  • If "Affecting Real Change" are made aware of a cancellation or significant change and we consider that the change will dramatically affect your placement we will endeavour to inform you through the Volunteer user area accordingly.
  • Any advice given by "Affecting Real Change" on the cancelled or significantly changed placement is provided at our discretion and on a goodwill basis.
  • "Affecting Real Change" cannot accept or be held responsible for any expenses, costs, losses or compensation that you incur or request as a result of such cancellation or significant change.
    Unless it complies with these Terms and Conditions, you will not be entitled to a refund of any costs in the event of your placement being cancelled or significantly changed.

Prices and placement details

  • Prices and placement details quoted on our website or elsewhere are based on those costs provided by our partner organisations.
  • Prices and placement details are believed to be correct as of 1st March 2011 although changes and errors do sometimes occur.
  • "Affecting Real Change" cannot be held responsible nor does "Affecting Real Change" accept any liability for any errors or inaccuracies.
  • When "Affecting Real Change" becomes aware of any errors or inaccuracies "Affecting Real Change" will if we consider that the change will dramatically affect a placement advise our customers as soon as possible.
  • Like all countries, the prices in the developing world can change.
  • There are many reasons why they may be an increase in your costs, they include but are not limited to exchange rates, inflation, introduction of local taxes and local price increase to cover basic living costs.
  • Price increases are outside the control of "Affecting Real Change".
  • Volunteers accept that they will need to pay any difference in the prices in order to continue with the placement.
  • All placement and other details and descriptions are subjective. Services such as but not limited to, accommodation, meals etc are very likely to be of a much lower quality and standard than what you may be used to.
  • Health and safety standards in the destinations in which we work may be much lower than the UK.
  • It is up to the Volunteer to perform a health and safety risk assessment, before doing any volunteer work or offering any help.
  • "Affecting Real Change" strongly suggest a Volunteer does not attempt any volunteer work if the correct safety equipment has not been supplied.
  • It is up to the Volunteer to perform risk assessment on every situation (the volunteer work they are doing, the people they are with, going out late at night or on their own, the food/meals and water/drink). "Affecting Real Change" cannot be held responsible for any illness, injuries and loss of property.

Acceptance

  • Without the need to give any reasons "Affecting Real Change" reserve the right to refuse applications and/or registrations from volunteers or prospective volunteers.
  • If you have a medical condition that might affect your other people's enjoyment of their volunteering placement; you must advise "Affecting Real Change" at the time you register.

"Affecting Real Change" will automatically refuse applications from

  • Anyone who is or appears to be risk to himself or herself.
  • Anyone who is or appears to be risk to the people around or may come in contact with himself or herself.
  • Anyone who brings Affecting Real Change or the partner organisation they are working for or their coordinator(s) into disrepute.
  • Anyone with any child related protection issues.
  • Or any safety, sexual, bullying, lewd behaviour, alcoholism, smoking or drug issues or problems.

Termination of a placement

Affecting Real Change, their partners, or any of their coordinators or local representatives, at their discretion, can terminate the placement of any volunteer and/or their stay at any accommodation. The reasons for termination include but not limited to the problems or issues stated in clause Acceptance.

If your placement is terminated

  • No refunds of any kind will be payable.
  • Affecting Real Change and their partners will not accept any responsibility for any expenses, costs or losses of any nature that you may have incurred or incur as a result of a placement or stay at any accommodation being terminated (including any return or onward travel expenses).

A Volunteer may end a placement at anytime.

  • If you end the placement no refunds of any kind will be payable.
  • Affecting Real Change and their partners will not accept any responsibility for any expenses, costs or losses of any nature that you may have incurred or incur as a result of you ending a placement or stay at the accommodation (including any return or onward travel expenses).

Acceptance of risk

The nature of volunteering in developing countries is adventurous and involves a significant amount of personal inherent risk.

  • You acknowledge that there will be limited on site support at most locations.
  • Health services may be very basic or lacking.
  • Training on a placement will be lacking or informal at best.
  • The safety standards of local accommodation and transport will not meet European standards.

"Affecting Real Change" does not have the time or resources to liaise with overseas staff on matters such as homesickness or culture shock. It is up to the Volunteer to make sure their families back at home are kept informed and up-to-date.

"Affecting Real Change" accepts no responsibility for excursions or activities arranged through local, national or global agents or tour operators.

You accept and acknowledge that may see things that are disturbing or sights that you may consider to be immoral.
Although "Affecting Real Change" would never get involved in any personal relationship that a Volunteer may wish to enter in to if however a Volunteer does wish to enter in to a relationship with a local person, please keep in mind the following

  • Local and family customs, rules and laws.
  • Religious customs, rules and laws.
  • Health concerns, sexual or other.
  • Your placement is only temporary.

Minor emergencies

Although a local English speaking contact person is usually available, if you are involved in an emergency, crime or end up being sick or ill you accept you may have to deal with the effects by yourself. This includes but not limited to contacting the local Police, contacting your insurance company or getting to hospital. It is up to the Volunteer to make sure they have adequate travel insurance to meet such eventualities.

"Affecting Real Change" accepts no responsibility for claims for theft from accommodation which has been provided for you during your placement or where baggage and belongings are in the care of local representatives or carriers, whilst in transit or otherwise.

Factors outside the company's control (force majeure)

"Affecting Real Change" cannot be held responsible and compensation and refunds will not be made for any change or cancellation caused by war or threat of war, insurrection, riots, strikes, civil action, decisions by governments or governing authority, natural disaster, bad weather, technical or maintenance problems with transport, changes of schedules or operational decisions of over transport, changes of schedules or operational decisions of overseas institution directors or similar circumstances beyond our control. For the purpose of this contract we define the above as force majeure.

Foreign and Commonwealth Office (FCO) Travel advisories

If the FCO (http://www.fco.gov.uk) advises against all or non-essential travel to your destination

  • You will be entitled to withdraw from your placement.
  • Following such advice from the FCO, "Affecting Real Change" suggest all Volunteers get in contact with the British Embassy as soon as possible.
  • "Affecting Real Change" may decide to cancel placements or withdraw any further placements.
  • "Affecting Real Change" are not responsible for any expense, costs, losses or compensation as a result of any cancellations or withdrawals that you may have incurred or incur following such advice from the FCO.

Authority at placements

On all matters likely to endanger yours or the people around you safety or well being the decision of the local coordinator is final.
You agree to abide by the authority of the local coordinator and local staff in all matters.

Local laws and customs

You must, at all times, strictly comply with the laws, customs, foreign exchange, drug and alcohol regulations of your destination.

Travel documents

You must be in possession of

  • Valid passport
  • Visa
  • Permits and certificates including vaccination certificates
  • All Volunteers over the age of 18 years must pass a DBS (previously CRB) check and provide details for two independent referees - please view our Safeguarding policy here.
  • Insurance policies

Any advice given by "Affecting Real Change" or their partners regarding visas, vaccinations, climate, clothing, special equipment, etc. is provided at our discretion and on a goodwill basis. We cannot accept any responsibility for any errors or omissions to the information provided.

"Affecting Real Change" cannot be held responsible if a Volunteer is refused entry to their destination country.

A Volunteer is very likely to be refused entry if he/she does not have the correct documentation.

"Affecting Real Change" will not accept any responsibility for any expenses, costs or losses of any nature that you may have incurred or incur as a result of you being refused entry in to any country (including any return or onward travel expenses).

Problems or Complaints

Whilst in your destination country if you have any problems or complaints then the best person to deal with them is your local coordinator from our partner organization. In most cases he/she can deal with complaints quickly with no fuss.

If however your local coordinator cannot deal with your complaint then "Affecting Real Change" does have limited advocacy powers. Although please note:

  • We are dealing with a developing country so a delay of a day or two is not uncommon.
  • It is not our country, so we cannot tell them what to do.
  • Your placement is between you and the partner organisation therefore we can only provide assistance.

All advice or help given by "Affecting Real Change" is provided on a goodwill basis only.

As a private Volunteer you are entitled to leave at anytime.

"Affecting Real Change" cannot accept any responsibility for any expenses costs, losses or compensation of any nature whatsoever that you may have incurred, incur or request as a result of leaving a placement early because of unresolved issues or problems.

Liability

As defined in the "Package Travel, Package Holidays and Package Tours Regulations 1992" ("the Regulations") "Affecting Real Change" is not a tour or package holiday operator. "Affecting Real Change" does not sell or offer for sale any "packages" or act as an "organiser" within the meaning of the already stated regulations and therefore the "Package Travel, Package Holidays and Package Tours Regulations 1992" do not apply to the services we provide.

Except for Terms and Conditions already stated in this document "Affecting Real Change" has no control over and cannot accept any liability over the acts, services, arrangements or omissions of it's partner organisations whose placements are advertised on our website.

"Affecting Real Change" has no control over and cannot accept any liability over the acts, services or behaviour, be it in written, verbal or physical, by any private citizen, the Government or any of its agencies.

Your placement and any and all contracts, arrangements, agreements and/or services either written or verbal are between you and our partner organisation. As such "Affecting Real Change" cannot accept liability or any responsibility for any expenses costs, losses or compensation of any nature whatsoever that you may have incur or incurred.

"Affecting Real Change" cannot accept liability or any responsibility for any expenses costs, losses or compensation of any nature whatsoever that you may have incurred, incur or request as a result of any acts or omissions of any Volunteer, whether they found their placement via "Affecting Real Change" or otherwise and whether those acts or omissions are verbal, written or physical.

"Affecting Real Change" maximum liability to you, if we are found to have been at fault is limited to the registration fee you paid to us at the time of registration.

"Affecting Real Change" does not exclude or limit any liability for death or personal injury which arises as a result of our negligence.

You and "Affecting Real Change" agree that English Law and no other will apply to your/this agreement with us and to any dispute, claim or other matters of any description which may arise. Both parties also agree that any dispute, claim or other matter of any description which arises between us must be dealt with by the Courts of England and Wales.
